Three justices of the Connecticut Supreme Court said the majority overstepped and practically enacted a new statute, placing the high court’s policy preferences over the Legislature’s intention.

Justice Steven D. Ecker, joined by Chief Justice Richard A. Robinson and Justice Raheem L. Mullins, wrote in the dissent that the majority’s conclusion “advances a legitimate and even praiseworthy public policy” to protect tenants from overpaying unpredictable amounts for utilities in a building with a shared meter.
