A federal judge in Massachusetts has denied JetBlue’s motion for summary judgment, finding it was best for a jury to decide whether the airliner was negligent in its maintenance actions following repeated incidents of an overhead bin detaching from its compartment, with one of them allegedly injuring a passenger.

U.S. District Judge Indira Talwani for the District of Massachusetts denied JetBlue’s motion for summary judgment in a personal injury case filed by David Mellor after he was struck by an overhead bin door that detached during a flight on a JetBlue A320-232 aircraft in February 2018. The overhead bin door had been shut during the flight, and during the descent, another passenger stood up and unlatched the door. After the door was unlatched, it detached and fell on Mellor, according to the order filed Sept. 29.
