Prosecutors filed a brief that did include a few details about the case, including the last name of the lawyer who was subpoenaed. That document was later replaced with a different version after The National Law Journal published a story about the case.

The Justice Department was against sealing the oral arguments. Lawyers for the government said neither side would need to reveal details about the grand jury investigation in order to make legal arguments about whether traders’ former lawyer should have to comply with the subpoena.

The lawyer did not challenge the subpoena, according to court filings, but two of the four traders under investigation did.

The identity of the Fourth Circuit judges assigned to the subpoena fight is unknown. The court doesn’t disclose the three-judge panel presiding in a particular case until the day of arguments.
