There is clearly a disconnect between the Dobbs Supreme Court and the public’s view on women’s reproductive freedom. In the 2023 election, Ohio, a state that voted for Trump in the past two presidential elections, passed a ballot initiative putting protections for reproductive health decisions in the state constitution. In Virginia, Democrats took control of the state house of delegates, which effectively blocked efforts by their conservative governor to restrict reproductive freedom. In 2022, solidly-red Kentucky and Kansas rejected efforts to restrict reproductive rights on ballot initiatives.

Recent polling shows that 61% of Americans believe Dobbs was a bad decision. 69% believe abortion should be permitted in the first trimester. Only 13% oppose abortions under any circumstance.
