Litigators from Fox Rothschild and Fellows LaBriola have asked the Georgia Court of Appeals to determine whether the verbal terms of a purchase agreement binding before they are put into writing, they said in oral arguments on June 21.

According to the plaintiff-appellants, “If allowed to stand, the trial court’s ruling could have significant implications for Georgia businesses. It would disrupt the oral contract/written confirmation process that businesses routinely use. Large retailers could hold small businesses hostage by instituting post-sale fees that the parties never agreed to.”
