New criticisms of the current Gwinnett County District Attorney Office’s performance emerged Wednesday as Superior Court Judge Ronnie K. Batchelor held a motions hearing to recuse the office from prosecuting a recently revived 2002 murder case.

Batchelor quashed the defense’s three motions to subpoena the allegedly offending litigators—Managing District Attorney Christopher DeNeve, Chief Assistant District Attorney Daryl Manns and Gwinnett County District Attorney Patsy Austin-Gatson—that were filed following the incident. Bachelor said he would take the motion to recuse under consideration and provide an answer within 30 days.
