Atlanta-based personal injury attorneys Mike Rafi and Alex Brown from the Rafi Law Firm recently leveraged a court’s order for rebuttable presumption sanctions to secure a $4M settlement against a DeKalb County apartment complex, represented by G. Lee Welborn of Downey & Cleveland, where a guest was shot during an attempted robbery.

The court’s order came after the named defendant refused to comply with discovery and the plaintiffs convinced DeKalb County State Court Judge Johnny Panos it had more documentation than it was providing – and that it destroyed some of it after the suit was filed. The order specifically targeted the apartment complex owner. Defense counsel was not involved in any way with spoliation.
