The attorney for a Delaware man serving life in prison said his conviction should be tossed out in part because prosecutors failed to clarify their argument for guilt was based on witness testimony and other evidence presented at trial.

The Delaware Supreme Court justices on Wednesday grappled with issues such as how to regulate prosecutors’ speech and whether the issue was even preserved for appeal after defense counsel failed to raise an objection during the trial.
