More than a year after Dominion Voting Systems brought its second complaint alleging defamation by Fox News personalities, Fox News Network and Fox Corp. have moved to consolidate the two cases pending in Delaware Superior Court, claiming Dominion has pushed back on consolidation in an effort to get two chances to make the same case.

Several Delaware attorneys confirmed while it’s more common for such a motion to be made further in advance of trial—the motion was filed on Dec. 1, and the Fox News trial is set to begin in April 2023—this motion is more likely a logical next step for Fox’s trial team post-motion to dismiss than a move aimed at reducing legal bills as Fox Corp. defends itself in multiple Delaware courts.
