SAN FRANCISCO — The Ninth Circuit U.S. Court of Appeals today lifted its stay of an injunction against the U.S. policy against gays and lesbians serving openly in the military.
In the months since the appeals court granted a stay of the ruling that found “Don’t Ask, Don’t Tell” unconstitutional and unenforceable, the three-judge panel concluded today, the “circumstances and balance of hardships have changed.”
