The $7.00 fee for service of process by mail in Special Civil Part cases and small claims will be reinstated effective April 1, 2009 and the service by mail program will continue as it existed prior to January 14, 2009 when the fee was reduced from $7.00 to $4.00 on a temporary basis. The reduction of the fee from $7.00 to $4.00 was required at that time by the expiration of the statutory authority of the Administrative Director of the Courts to adjust the fee as postal rates change. The reinstatement of the $7.00 fee and continuation of the program is possible because the Legislature has passed and the Governor has signed legislation that reinstates the authority of the Administrative Director to adjust the fees (L. 2009, c. 32). The service by mail program is an essential component both of ensuring access to the court for many plaintiffs and of the expedited processing and disposition of complaints in the Special Civil Part.
