Even if defendants are found not guilty by a jury, a federal judge can sentence them as if they were found guilty. While "acquitted conduct sentencing" goes against virtually everything we know and respect about the American criminal justice system, such sentences are regularly imposed by federal judges and the U.S. Supreme Court has even approved of the practice, despite the U.S. v. Booker decision.
