An attorney and his client must pay additional sanctions for appealing a trial court’s earlier $95,000 award against them for knowingly bringing a time-barred securities fraud lawsuit, the U.S. Court of Appeals for the Second Circuit has decided.

Moreover, the pair could face still more penalties if they cannot allay a District Court judge’s suspicion that they are trying to “frustrate” the original award.
