A client consulted with me on a personal injury case. After some initial cooperation, the client has not cooperated with me and in fact has not responded for some period of time. The statute of limitations passes in one week. I have prepared and sent the client a letter, both by mail and hand delivery, that I will not file a lawsuit and advised the client of the passage date of the statute of limitations. Have I fulfilled my ethical and professional responsibility?
Representation of a client is a two-way street. A client has to also cooperate. If fees are due or costs are owed, the client has to provide those or else the representation will not be able to go forward.
