The U.S. Court of Appeals for the Third Circuit has joined half a dozen other federal appeals courts in reaffirming a century-old doctrine dictating that a bankruptcy court must first grant leave before a trustee can be sued in another venue.
Although the doctrine predates the modern Bankruptcy Code, the three-judge panel said in In re VistaCare Group , it stands as a common law principle.
