A deeply divided en banc Commonwealth Court has ruled that an in camera review by the state’s Office of Open Records may be necessary in situations where an agency’s affidavits are insufficient to show that records are exempt under the state’s Right-to-Know Law.
The panel directed the OOR to conduct an in camera review to determine whether portions of Governor Tom Corbett’s calendars that were redacted before being made public were exempt from disclosure under the RTKL’s exception for records that reflect predecisional deliberations.
