In Banister v. Davis, we represented a habeas petitioner in the U.S. Supreme Court—beginning at the at the cert reply stage after the court called for a response to his pro se cert petition. Habeas petitioners often face an uphill climb in the Supreme Court, but we were able to secure a decisive 7-2 reversal of the U.S. Court of Appeals for the Fifth Circuit with a briefing and amicus strategy that developed a range of arguments intended to appeal to a diverse coalition of Justices. We explored the history of the “abuse of the writ” doctrine alongside arguments rooted in precedent and practical court administration.
