Citing “managerial and operational confusion” ahead of the November presidential election, a New York federal judge issued a nationwide preliminary injunction Monday requiring the U.S. Postal Service to treat all election mail as first-class mail in order to ensure that all absentee ballots are counted.

The ruling, from U.S. District Judge Victor Marrero of the Southern District of New York, found that recent changes instituted under Postmaster General Louis DeJoy had undermined public confidence in the Postal Service’s ability to handle an expected an “unprecedented surge” in mail-in voting amid the lingering coronavirus pandemic.
