The New York state Assembly will suspend its impeachment investigation against Gov. Andrew Cuomo when he resigns later this month, the top Democrat in the chamber said Friday afternoon.

Assembly Speaker Carl Heastie, D-Bronx, said the chamber’s judiciary committee found evidence that could have led to articles of impeachment against the third-term governor. But the Assembly is going to call off the probe once the governor steps down, he said, citing the perspective that the state constitution does not allow the Legislature to impeach someone who is already out of office.
