Brian Flores may pursue his racial discrimination suit against the NFL and three teams in federal court, a judge in Manhattan ruled on Wednesday in an order partially denying the league’s bid to compel arbitration in the case.

Flores, the ex-head coach for the Miami Dolphins who alleges in a class-action suit filed last year against the league that Black people are generally excluded from top leadership positions, may proceed with claims against the New York Giants, Houston Texans and Denver Broncos in federal court because he was not under contract with any of those teams when the alleged discrimination occurred, U.S. District Judge Valerie Caproni of the Southern District of New York found.
