Judge Tosses Emotional Distress Claim Against Lowe's Stores
A Pennsylvania federal judge has dismissed an emotional distress claim against a home improvement chain by a black couple whose sales receipt read "Thank You Black Lady for Shopping Lowe's." The cashier, who is black, testified she had to type identifying information to adjust the couple's transaction record but did not know their names. The judge wrote: "The designation is at most a mere insult, indignity, or epithet insufficient to support a claim for intentional infliction of emotional distress."Post & Schell Adds Two Lateral Partners
