Compensation is a serious sticking point for all firms attempting to strike a balance between rewarding rainmakers and evenly divvying up profits among partners, but one California firm has avoided the dilemma altogether with "tattooing." It works like this: The first partner to do business for a client can "tattoo" that client as his own. As long as that partner remains breathing and with the firm, no other partner can get billing credit for work done on behalf of that client.

Anything They Can Do, I Can Do Cheaper

Bagram's Black Hole

On its face, the legal status of detainees at Bagram, a U.S.-controlled air base leased from the government of Afghanistan, appears to be much like that of prisoners at Guantanamo Bay, a U.S. military station leased from Cuba. One would expect the Bagram detainees to benefit from legal arguments raised on behalf of Guantanamo inmates, whose due process rights the Supreme Court has repeatedly affirmed. But so far, that?s not the case.

Defending Detainees

One day he's on a brief with conservative scholar Richard Epstein, the next he's challenging the Guantanamo tribunals. Neal Katyal defies easy categorization. Just seven years after a Supreme Court clerkship, the young Georgetown University law professor has already figured in many important cases. Says a former deputy attorney general who supervised Katyal at the Department of Justice: "He is already a force, and he will be recognized as a national figure in the law."
