SAN FRANCISCO — McDermott Will & Emery is poised to poach Silicon Valley IP partner Fabio Marino from Orrick, Herrington & Sutcliffe, according to a person familiar with his plans.

The firms said they weren’t prepared to comment on the record. Marino, whose bio is still listed on Orrick’s website, joined Orrick in 2006 from Bingham McCutchen, where he had been co-chairman of the patent litigation and prosecution practice. At Orrick, he was chairman of the firm’s networking practice group. Marino declined to comment.
