Lawyers for Smartmatic are asking a judge to force Rudy Giuliani to comply with discovery in the voting technology company’s $2.7 billion lawsuit against Fox—claiming the former New York City Mayor is giving “excuse after excuse” to avoid turning over documents.

“‘The dog ate my homework.’ ‘I have to wash my hair.’ ‘I can’t go out, I’m sick.’ Since the dawn of time, people have made up excuses to avoid doing things they do not want to do. This is exactly what Giuliani has done here,” Smartmatic wrote in a motion for an order to show cause.
