A federal judge has ruled that a suit against Toys R Us, Babies R Us and others involving two children who were killed by a falling dresser can be sent back from federal court to the Beaver County Court of Common Pleas.

U.S. Magistrate Judge Cynthia Reed Eddy of the Western District of Pennsylvania granted plaintiff Deborah DeCostro’s motion to remand based on a lack of subject-matter jurisdiction. Prior to DeCostro’s motion, defendants Toys R Us, Babies R Us and former assistant store manager Michael Blain filed a notice of removal to federal court.
