A thoroughbred racetrack and casino near Rochester has no legal ground to challenge the building of a new casino 25 miles away, a state judge has determined.

Acting Albany Supreme Court Justice James Ferreira dismissed the action filed by the Finger Lakes Racing Association. He said the amendment to the state Constitution, approved by voters in 2013 authorizing up to four new casinos, did not require a state licensing board to consider the possibility of destructive competition to existing nearby gambling businesses.
