Consumer Class Action/Mass Tort Defense
Baldassare Vinti and Jeffrey H. Warshafsky of Proskauer Rose have entered appearances for Church & Dwight Co. in a pending class action over the labeling of its Zicam Pre-Cold treatments. The complaint, filed Jan. 5 in California Eastern District Court by Bursor & Fisher, alleges the defendant falsely claims that its products reduce the duration of the common cold. Mercedes-Benz has turned to lawyer Mehgan Gallagher of the Theta Law Firm to fight a pending breach-of-contract lawsuit. The suit, over alleged violations of the Song-Beverly Consumer Warranty Act, was filed Jan. 5 in California Northern District Court by Quill & Arrow on behalf of Robert Paul Thompson. J. Brugh Lower of Gibbons has entered an appearance for industrial equipment supplier Devco Corporation in a pending trademark infringement lawsuit. The suit, accusing the defendant of selling knock-off Graco products, was filed Dec. 18 in New Jersey District Court by Rivkin Radler on behalf of Graco Inc. and Graco Minnesota.
