The Massachusetts Supreme Judicial Court held that a neuropsychologist falls within the definition of “physician” under Civil Procedure Rule 35, regarding a judge’s order for the physical or mental examination of a person.

In 2016, Thomas M. Ashe fell approximately 45 feet from scaffolding at a construction site at Harvard Medical School, where he was working as a bricklayer. As a result of the fall, Ashe suffered serious and permanent injuries, according to the high court’s opinion filed April 15.
