Addressing a jurisdictional question of first impression, the U.S. Court of Appeals for the Tenth Circuit cited U.S. Supreme Court precedent in its 2-1 dismissal of an appeal which sought dismissal of a former employee's Title XII allegations under a "ministerial exception."
