The Montana Supreme Court denied a request by the state and the governor to file supplemental amicus briefing citing the U.S. Supreme Court's decision in Dobbs v. Jackson Women's Health Organization, which overturned Roe v. Wade in June.

The Montana Supreme Court has affirmed a lower court's preliminary injunction against three laws banning and restricting abortion access.
The state's Legislature enacted the laws during its 2021 session. The restrictions included banning abortion at 20 weeks of pregnancy, mandating an ultrasound offer and requiring documentation and creating obstacles to obtain medication for abortion.
