A federal judge has sided with a pair of Springfield, Massachusetts, attorneys in legal malpractice claims against them, rejecting a New York lawyer’s claims that communications after the dismissal of an underlying case tolled the three-year statute of limitations.

Derrick A. Spatorico, a partner at Pheterson Spatorico in Rochester, New York, filed a legal malpractice action against Egan, Flanagan & Cohen (EFC) and its attorneys, Thomas E. Day and Stephen Spelman, pertaining to their representation of him in an underlying corporate litigation matter. Accoding to its website, Pheterson Spactorico is a four-lawyer firm, while EFC has about 14 lawyers.
