Foley Hoag partner August T. Horvath has entered an appearance for Greenbrier International Inc., a Dollar Tree subsidiary, in a pending consumer class action over the company's 'Assured' brand lidocaine patches. The action, filed Sept. 9 in Illinois Northern District Court by Sheehan & Associates, takes issue with the defendant's claims that the patches provide maximum strength pain relief for up to eight hours. According to the suit, defendant misleads customers regarding the length of time the patches last and the strength of lidocaine within the product. Steven A. Zalesin, Jane M. Metcalf and Jenna Smith from Patterson Belknap Webb & Tyler have stepped in to represent Johnson & Johnson in a pending consumer class action over its labeling of Tylenol. The action, which accuses the company of failing to warn consumers that certain varieties of Tylenol contain titanium dioxide, a metal which can accumulate and cause harm inside the body, was filed Aug. 29 in California Southern District Court by Fitzgerald Joseph. Reed Smith partner James L. Rockney and attorneys from Cooley have entered appearances for Thorley Industries in a pending product liability class action. The suit, filed Aug. 29 in Pennsylvania Western District Court by Robert Peirce & Associates and Poulin Willey Anastopoulo, accuses the defendant of manufacturing and selling defective MamaRoo Baby Swings that pose a strangulation hazard to infants.
