A consumer class action against the Target Corp. will return to the U.S. District Court for the District of Arkansas for further consideration after a federal appeals court found that the lower court "effectively denied" the retailer an opportunity to establish federal jurisdiction.

Target filed a notice of removal to federal court based on jurisdictional thresholds in the Class Action Fairness Act of 2005—minimal diversity, more than 100 class members and over $5 million in controversy— after lead plaintiff Robert Leflar filed a class action lawsuit against the company in Arkansas state court, according to the U.S. Court of Appeals for the Eighth Circuit's Jan. 9 opinion.
