The U.S. Court of Appeals for the Sixth Circuit held that a district court did not follow the appropriate process for an on-the-merits, sua sponte dismissal of a student’s federal due process claims against Oberlin College pursuant to a Title IX investigation.

However, the appellate court still ultimately concluded that the dismissal on the merits was proper and, thus, affirmed the district court’s dismissal. The remaining claims were remanded to the district court for further proceedings, according to the opinion filed Feb. 14.
