Despite holding that the Washington Department of Children, Youth and Families failed to properly destroy records pertaining to an investigation into a family, the Washington Court of Appeals held the family was not entitled to monetary damages.

In an April 4 opinion, Judge Rebecca Glasgow concluded that RCW 26.44.031(5)(a) did not give rise to an applied cause of action for monetary damages, as plaintiffs Russel and Megan Carter attempted to argue, affirming a lower court’s grant of summary judgment to the Washington Department of Department of Children, Youth and Families.
