The West Virginia Supreme Court unanimously held Speedway is not liable in a $2 million wrongful death case, finding that it had no duty to prevent one of its employees from driving under the influence of drugs after her shift and subsequently causing a deadly motorcycle crash.

Deborah L. Jarrett, as the executrix of the Estate of Kevin M. Jarrett, sought a wrongful death action against Speedway after its employee, Brandy Liggett, collided with the decedent’s motorcycle, killing him. During her nine-hour shift at Speedway and at the time of the accident, Liggett was under the influence of illegally obtained prescription drugs, according to the state high court’s opinion released June 8.
