In a decision that’s likely a harbinger of others as various emergency aspects and presidential executive orders tied to the pandemic come to an end, the U.S. Court of Appeals for the Eighth Circuit has declared “moot” a legal battle between federal contractors and subcontractors and President Joseph Biden over an attempt to impose a vaccine mandate on the contracted workers.

The circuit court granted an unopposed motion to voluntarily dismiss an appeal, which was recently lodged by Biden and other federal executive branch officials in the underlying action, and the appeals court went a step further and also said, “We conclude this appeal has become moot.”
