LEAVING LEWIS - Clients of Lewis Brisbois Bisgaard & Smith have been switching representation during a tumultuous two months for the firm, Law.com's Justin Henry reports. The firm lost Los Angeles County as a client in the wake of the release of emails showing the use of derogatory language by former employment chair John Barber and vice chair Jeff Ranen. Meanwhile, a number of clients have also agreed to transfer files previously handled by Lewis Brisbois to Barber Ranen, which has since rebranded to Daugherty Lordan after booting Barber and Ranen. Many observers have noted that the emails, all of which were exchanged during Barber and Ranen's tenures at Lewis Brisbois, don't reflect well on the firm they departed, particularly since the firm didn't investigate their behavior until after they were gone.
NETFLIX AND CHILLED - The plaintiffs bar's use of a 35-year-old video rental law to take on streaming platforms could soon be going the way of Blockbuster. A recent win by a streamer—and its counsel at Weil—in a data privacy dispute could be another sign that Video Privacy Protection Act cases are not long for this world, Law.com's Brad Kutner reports. Many of these disputes are now going to arbitration rather than litigation, against the wishes of plaintiffs counsel. "Plaintiffs want to be in court, not arbitration where it's less formal and there's less rules for discovery," said Daniel S. Marvin, data privacy partner at Kennedys.
ON THE RADAR - Progress Software Corp. and PBI Research Services were hit with a data breach class action Wednesday in Massachusetts District Court. The complaint accuses the defendants of failing to implement adequate security measures leaving over 2.7 million individuals' personally identifiable and financial information vulnerable to cyberattacks. The class is represented by Hagens Berman Sobol Shapiro; Levin, Sedran & Berman; Goldenberg Schneider; and the Lyon Firm. Counsel have not yet appeared for the defendants.
