A suspended Seattle-area attorney has appealed the dismissal of allegations against a Virginia family lawyer representing his estranged wife, alleging opposing counsel is behind various schemes to have him wrongfully arrested and imprisoned without due process.

Not only were Richard M. Simpson’s claims against the defendants, Yvonne J. Nageotte, and her firm, Nageotte, Nageotte & Nageotte, and the City of Fredericksburg, Virginia, dismissed for lack of jurisdiction or failure to state a claim, but Senior U.S. District Judge Henry E. Hudson of the Eastern District of Virginia also ordered Simpson to pay approximately $3,800 in attorney fees and costs as a sanction for allegedly sending hundreds of graphic and threatening emails to the defendants and other court officials, according to a memorandum opinion filed June 27.
