The U.S. Court of Appeals for the First Circuit affirmed the dismissal of a certified nursing assistant's lawsuit against a state-funded healthcare facility, concluding that the defendants were entitled to qualified immunity.
In an Oct. 25 opinion, authored by U.S. Court of Appeals Judge Gustavo A. Gelpí for the First Circuit, the court upheld the Massachusetts District Court's dismissal of a certified nursing assistant's lawsuit against a state-funded healthcare facility that houses veterans, after he asserted violations of his constitutional substantive due process rights to a safe work environment, to be free from a state-created danger, and to bodily integrity, during the COVID-19 outbreak..
