A popular St. Louis-area restauranteur is firing back in court at an insurance company that allegedly denied claims after a heavy rainstorm brought catastrophic damage to his restaurant and later accused him of fraud and defamation when he spoke to the press about the issue.

Charlie Gitto’s From the Hill Italian restaurant filed a complaint in the St. Louis County Circuit Court on Dec. 18, accusing SECURA Insurance of abuse of process for retaliating once the restaurant owner reported his denial of his claim for damaged property. The owner, Charlie Gitto Jr., told local media that because “SECURA had unlawfully denied the insurance claim,” he would have to close his restaurant, according to the complaint.
