A federal judge in Virginia granted Norfolk State University’s motion to dismiss an employment discrimination action against it, as well as the college’s request to sanction the former employee after her attorneys allegedly misinterpreted critical facts set out in an amended complaint.

Alexander Leonard Taylor Jr., a solo practitioner in Richmond, Virginia, filed a sole count of retaliation in violation of Title VII on behalf of Brenda Johnson against Norfolk State University in the U.S. District Court for the Eastern District of Virginia in May 2022. Johnson, a Black woman, worked as an administrative assistant and test proctor at Norfolk from November 2018 until October 2021, when she was terminated—which Norfolk claims was due to performance.
