The Virginia Supreme Court determined a lawyer must disclose the death of a client to opposing counsel or the court, approving a legal ethics opinion, effective immediately.
In November, Virginia State Bar President Chidi I. James and Executive Director Cameron M. Rountree filed a petition requesting consideration of a legal ethics opinion that asked what duty a lawyer has regarding the duty to disclose a client’s death to opposing counsel or the court, when their client dies during representation.
