The panel held that the act granted Gov. Kate Brown and Director of Oregon Health Authority Patrick Allen immunity from liability as policymakers and due to the limited vaccine supplies available at the time.

The Oregon governor and the state's director of Health Authority are immune from COVID-19 vaccination related claims under the Public Readiness and Emergency Preparedness Act, the U.S. Court of Appeals for the Ninth Circuit ruled.
