A federal judge in Illinois is allowing a drug company's lawsuit over the untimely development of drug medication to continue against pharmaceutical companies it had partnered with to develop medications.

In a July 8 opinion, District Judge Sara L. Ellis of the U.S. District Court for the Northern District of Illinois denied the Bausch Health defendants' motion to dismiss plaintiff Chandra V. Pharmaceutical Consultants' claim for breach of the implied duty of good faith and fair dealing, after the parties entered into separate agreements for the development of two generic ophthalmic drugs.
