After recent failed appeals to the U.S. Courts of Appeals for the Fifth and Sixth circuits, the Biden administration has taken the fight over new Title IX rules to the U.S. Supreme Court, requesting that the highest court set aside federal court injunctions blocking the Aug. 1 enactment date.

After the circuit courts of appeal declined to intervene last week, U.S. Solicitor General Elizabeth B. Prelogar, on behalf of the Department of Education and Secretary Miguel Cardona, filed stay applications Monday with the U.S. Supreme Court. The applications sought a partial stay of the preliminary injunctions issued in June by the U.S. District Courts for the Western District of Louisiana and the Eastern District of Kentucky in favor of states challenging Title IX protections for members of the LGBTQ+ community, among others.
