Days before the Aug. 1 enactment date for new Title IX rules, a federal court in Alabama finally sided with the Biden administration as it awaits a decision from the U.S. Supreme Court on whether to side-step federal court injunctions blocking the revised rules.

That was quickly overshadowed by a ruling late Wednesday by the U.S. Court of Appeals for the Eleventh Circuit granting challenging states’ injunction for the new rules going into effect Thursday. The court said that the Department of Education is enjoined from enforcing its final pending further order, in the four challenging states—Alabama, Florida, Georgia, and South Carolina.
