Birkenstock’s patent and trademark infringement suit against footwear competitor White Mountain International is moving forward, after a federal judge in Massachusetts found similarities between the companies’ sandals and clogs at issue.

In a Sept. 4 opinion, U.S. District Judge Patti B. Saris for the District of Massachusetts concluded that Birkenstock adequately alleged claims for design patent, trademark and trade dress infringement against White Mountain and American Exchange Time, finding similarities between White Mountain’s shoes and Birkenstock’s two-strap sandal, big-buckle sandal, toe-loop sandal, and its Boston and Buckley clogs.
