The Idaho Supreme Court is weighing whether a legal malpractice suit can be reinstated after a lower court took issue with a key expert’s standard of care qualifications in the underlying medical malpractice dispute.

The arguments Monday focused on whether the Ada County court incorrectly tossed the legal malpractice suit Julene Dodd v. Rory Jones, after finding that the trauma surgeon the plaintiff retained to prove her underlying medical malpractice case was viable failed to show he was familiar with the local standard of care for general surgeons where the plaintiff had been treated.
