The non-fungible token marketplace OpenSea has been hit with a securities class action in a federal district court in Miami over its alleged scheme to mislead investors that the NFTs sold on its website did not constitute the sale of securities, despite a clear indication from the U.S. Securities and Exchange Commission that they did.

Adam Moskowitz, the managing partner at the Moskowitz Law Firm in Coconut Grove, Florida, is among the attorneys who represent the plaintiffs, Anthony Shnayderman and Itai Bronshtein, on behalf of themselves and all others similarly situated against the defendant, Ozone Networks Inc. or OpenSea.
